APPEALS - STATE AND FEDERAL
Among the corps of Lowis & Gellen trial attorneys are several who represent clients in the appeal and defense of lower court decisions. This practice requires a particular concentration of skills, as an appellate argument is largely limited by the findings and proceedings of the lower court. Decisions turn on detailed analysis of the case, persuasive writing, oral argument and technical procedure. These are areas of mastery for Lowis & Gellen appellate attorneys.
It is an unusual circumstance in a law firm of its size, but three Lowis & Gellen attorneys were selected on graduation from law school for the honor of serving as law clerks to Appellate Court Justices: one in the Appellate Court of Illinois, one in the United States Court of Appeals for the Seventh Circuit and one in the Illinois Supreme Court. Additionally, one of our partners, Joan M. Kubalanza, is a former Associate Judge of the Circuit Court of Cook County and has served as an Adjunct Faculty Member at the John Marshall Law School, teaching Appellate Advocacy. She was also appointed an Associate Member of the Illinois Supreme Court Committee on Jury Instructions in Civil Cases. Gerald Haberkorn, a senior litigation partner, is a former editor of the Appellate Lawyers Law Review, published by the Illinois Appellate Lawyers Association, and is serving by appointment of the Illinois Supreme Court on the Court's Judicial Performance Evaluation Committee.
We handle appeals at all levels of the appellate system in both state and federal courts - and have decades of representation before these courts in matters as diverse as medical malpractice, common law fraud, consumer fraud, product liability, will contests, employment torts, restrictive covenants, commercial contracts, preliminary injunctions and federal anti-discrimination cases.
